USER AGREEMENT AND POLICIES
TERMS AND CONDITIONS
This agreement covers your use of the site and the Services of Gameday Sportswear and Events. This service permits customers and potential customers to have professional relationships with one or more of the following: (1) institutions of higher learning and other designated collegiate groups noted by that of the institution; (2) corporations and small businesses; (3) elementary and secondary schools, to design and purchase custom merchandise. You understand that by using this site and the services provided, you have agreed to the terms and conditions of this agreement and you agree to use the site solely as provided by in this agreement.
INTELLECTUAL PROPERTY RIGHTS OF GAMEDAY SPORTSWEAR AND EVENTS
Gameday Sportswear and Events is committed to the appropriate and legal use of the intellectual property of others and we require our customers to adhere to this understanding as well. Unless otherwise noted, all images, illustrations, designs, icons, photographs and other materials that appear within the site are a copyright, trademark and other intellectual properties owned by Gina Bennett, owner of Gameday Sportswear and Events.
Products listed within the site should not be resold commercially. Gameday Sportswear and Events reserves the right to display such designs or offer them (in variations) to other customers.

In addition, Gameday Sportswear and Events has the sole discretion to reject any order that is considered false, defamatory, obscene, profane, displays irresponsible use of alcohol and drugs, advocating persecution based on gender, age, race, religion, disability, or national origin or is otherwise deemed inappropriate by Gameday Sportswear and Events' production.
You agree to not use Gameday Sportswear and Events materials to create any other material that is unlawful, harmful, threatening, abusive, harassing, false, vulgar, or invasive. This includes any infringes on any patent, trademark, trade secret, or copyright of any third party's privacy policy.
PAYMENT POLICY
Gameday Sportswear and Events accepts online or telephone payment via credit card, debit card or Paypal. All payments sent electronically, are securely transmitted. All payments must be paid in full at the time of pickup.
SHIPMENT/ DELIVERY TIMES
Gameday Sportswear and Events orders are generally delivered within a 2-week period (14) business days. Customers who are concerned about meeting deadlines should contact our Sports Actvities and Events Director or Accounts and Production Director. Rush orders available only on screen-printed apparel items. This is available for an additional charge. Rush orders are typically delivered within a week (7) days, of ordering. Delivery times may vary during the holiday seasons.
CANCELLATION POLICY
Standard delivery orders, you may cancel your order within twenty-four (24) hours of submitting your order by contacting info@shopgameday.net or (330) 822-4005. Any orders requiring "fast" delivery, you cannot change or cancel your order. No exceptions.
LIMIT OF GAMEDAY SPORTSWEAR AND EVENTS RESPONSIBLITY
Gameday Sportswear and events is only responsible for acting only on the instructions sent or discussed between Gameday Sportswear and Events. Gameday Sportswear and Events does not assume responsibility for malfunctions in communications not under its control that may affect the accuracy or timeliness of any orders you send. Gameday Sportswear and Events is not responsible should you give incorrect instructions or if your credit card payment is not processed by your credit card company. All items contained within the site, including text, graphics, links or other items are provided "as is" and "as available". Gameday Sportswear and Events will do its best in order to replace and notify (in a timely manner), an item that may no longer be available.

Artwork: Gameday Sportswear and Events is not responsible for any damages after the final sales and final approval of said contract. Gameday Sportswear and Events will not print an order without the final consent of second party. Second party must specify name, logo and design and assumes all responsibility for trademark, trade name infringement and design as of final approval. After final approval, Gameday Sportswear and Events guarantees to fulfill the contract as agreed upon in the final approval. Second party will compensate and hold seller harmless for all damages, including but not limited to costs and attorney fees, costs of suit and loss of damages.

ARTWORK TERMS AND CONDITIONS:
Gameday Sportswear and Events holds true to the "no art fee and no service fee". However, this motto is with the intent to buy. If the buyer has not placed an order by the end of thirty (30) days, from the initial contact, a twenty percent (20%) art fee and service fee will be added to the final bill. It is the responsibility of the buyer to be active and attentive to their order. This includes but not limited to email correspondence, artwork approval, and apparel approval.
Due to differences in ink pigments, computer monitors, and printer settings, Gameday Sportswear and Events cannot guarantee colors and designs will "exactly" match the proposal of said designs. Gameday Sportswear and Events reserves the right to alter art in any way to best compliment the compatible printing capabilities on actual garment(s) as necessary. INTELLECTUAL PROPERTY CLAIMS
Gameday Sportswear and Events respects the intellectual property rights of others. For trademarked items, we need written approval for the use of any trade mark. If you believe your copyright, trademark, or other intellectual property right is being infringed by a user of Gameday Sportswear and Events, please provide written notice to the following Director for notice of claims infringement:

In order for us to respond to your notice, it must contain the following: (1) contain a physical or electronic signature; (2) identify the copyrighted work alleged to be infringed; (3) identify the allegedly infringe material in a precise manner; (4) which best way to contact you (i.e. physical address, telephone number, and email); (5) contain a statement of good faith notice of copyrighted material; (6) contain a statement that the information in a written notice is accurate; (7) contain a statement, under penalty of perjury, that you're authorized to act on behalf of the copyrighted , trade mark, or intellectual property's right owner.

HOW WE USE YOUR INFORMATION

We collect your information by users subscribing through our site. We may combine all of the information we collect about you from other sources (i.e. events and the physical store front).

Through subscribing through the site, you may provide us with certain information that includes your name, email address, phone number, credit or debit card information and shipping or billing address. Other information that we may collect is what is provided by you through messages to Gameday Sportswear and Events.

Through marketing and advertising, providing your personal information allows us to provide you with special offers, product information and other marketing material. This type of marketing may come through as personal ads, email, or other third party website. You may unsubscribe at any time.

WE DO NOT TARGET CHILDREN UNDER THE AGE OF THIRTEEN (13) AND WE DO NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM CHILDREN UNDER (13).

WE DO NOT SHARE YOUR INFORMATION TO ANYONE OUTSIDE THE GAMEDAY SPORTSWEAR AND EVENTS COMPANY. WE WILL NOT RELEASE ANY INFORMATION PERTAINING TO ANYONE WITHOUT A WARRANT. THIS INCLUDES FAMILY AND FAMILY MEMBERS. WE STRIVE TO PROTECT EVERYONE'S PRIVACY.
